CAN-SPAM Act Resources

RE: Federal CAN-SPAM Act of 2003

This memorandum is to make you and your respective staffs aware of your responsibilities related to the recent CAN-SPAM Act of 2003 (Controlling the Assault of Non-Solicited Pornography and Marketing), which is designed to control unwanted email solicitations and which imposes legal restrictions on the sending of some types of email by the University. Please share this memorandum widely throughout your organization.

The CAN-SPAM Act, effective January 1, 2004, applies to electronic mail whose primary purpose is to communicate a commercial advertisement or promote a commercial product or service. The law applies equally to broadly sent electronic mail messages and to single email messages. Guidelines for complying with this Act within the University of California are attached to this memo.

As with any new legislation, there may be situations where it is not clear how the law applies or how it should be interpreted. The Federal Trade Commission is expected to provide clarification on certain points in the coming months. More immediately, questions about specific situations may be directed to Kent Wada, Director, IT Policy at kent@ucla.edu or 6-3874. Kent will be coordinating with External Affairs staff and with his counterparts systemwide to obtain interpretation for the University.
